Terms and Conditions of Use (TCU)
1. Purpose and Contractual Relationship
These Terms and Conditions of Use (hereinafter: the “Terms”) define the rules and
conditions governing the use of the Babylonelearning online training platform (hereinafter:
the “Platform”), as well as the rights and obligations of its users.
The Platform provides a service that connects:
● Learners wishing to access digital educational content and services (hereinafter: the
“Users” or “Learners”);
● With trainers, institutions, or partner organizations delivering their courses, programs,
or educational services via the Platform (hereinafter: the “Educational Providers”).
These services are offered or made available under the Babylonelearning brand in several
jurisdictions, including:
Algeria,
Ireland,
United States,
as well as throughout the
European Union and other countries where the platform may
be legally operated (hereinafter: the “Eligible Countries”).
Access to and use of the Services are subject to these Terms, which every User must
carefully read and accept before creating an account or accessing the Platform.
Acceptance of the Terms establishes a contractual relationship between the User and
Babylonelearning. These Terms expressly replace any prior agreements.
They may be supplemented by specific terms and conditions applicable to certain services
(e.g., subscriptions, events, certifications, promotions). In the event of any contradiction, the
specific terms shall prevail over these Terms.
Important note: Babylonelearning acts solely as a technological intermediary facilitating the
connection between Learners and Educational Providers. Babylonelearning is not
responsible for the pedagogical content produced by third parties nor for the intrinsic quality
of the teaching delivered by the Providers.
2. Who Provides the Babylonelearning Service?
The service is operated by Babylonelearning and managed through three legal entities
depending on the area of operation:

3. Definitions
● Platform: refers to the Babylonelearning website, accessible through a web browser.
● Account: personal space required to access the Services offered by
Babylonelearning, created by the User with login credentials.
● Terms: these Terms and Conditions of Use (TCU).
● User / Learner: any natural or legal person registered on the Platform and using the
Services for learning purposes.
● Educational Provider: any natural or legal person (trainer, teacher, training
organization, educational institution) offering educational content or services via the
Platform.
● User Content: any material provided or published by the User on the Platform,
including texts, documents, comments, reviews, contributions to forums or
collaborative spaces, audio or visual files.
● Educational Content: any course, module, program, video, document, or
educational material made available by Babylonelearning or its Educational
Providers.
● Services: all services offered by the Babylonelearning Platform, including access to
online courses, learning features, educational resources, and monitoring tools.
● Fees: applicable prices for subscriptions, courses, certifications, or other paid
services, displayed transparently before purchase.
● E-payment: secure electronic payment methods authorized by law (bank card,
e-wallet, partner payment gateways).
4. Access to the Platform and Services
The Service is accessible:
● To any adult individual with the legal capacity to enter into contracts.
● To any legal entity (e.g., school, company, training organization) represented by an
authorized person.
Access conditions:
● The User must be at least 18 years old to create an individual account.
● Minors may access the Services only under the responsibility and with the express
consent of a parent or legal guardian.
● Unauthorized or fraudulent access constitutes a violation of these Terms and
Conditions.
5. Acceptance of the General Terms and Conditions
Acceptance of the GTC is confirmed by checking a box during registration or first login.
● This acceptance must be full and unconditional. Any acceptance with reservations is
considered null and void.
● The use of the Platform outside the framework defined by the GTC exposes the User
to sanctions, which may include account deletion.
6. Registration
Registration is completed online via a form available on the Babylonelearning website.
Mandatory information includes: full name, email address, phone number, and password.
● Any incomplete registration or containing false information will be considered invalid.
● Verification of the email address and/or phone number may be required before
account activation.
● Once validated, registration grants access to a personal space where the User can
manage their profile, follow courses, access educational resources, and view their
history.
7. Description of the Service
Babylonelearning is a digital online training platform (LMS) that connects Users (learners)
with Educational Providers (trainers, institutions, training organizations).
Access to the Services requires an active user account, a compatible device (computer,
smartphone, tablet), and a stable Internet connection (Wi-Fi or mobile data).
The Services include:
● Access to online courses, training modules, and educational content.
● Interactive features (quizzes, forums, virtual classrooms, assessments).
● Tracking and certification tools for learners.
7.1 Preliminary Checks
Before enrolling in a course or accessing content, the User must ensure that:
● The course information (title, description, duration, prerequisites) matches their
expectations.
● The Instructor is properly identified on the platform (validated trainer profile).
● The terms (e.g., free/paid, teaching language, available materials) are clearly
indicated.
The account holder remains fully responsible for any activity carried out from their personal
space, including when allowing third parties (e.g., colleagues, family members) to access
content via their account.
7.2 Service Pricing
Some Services may be free, while others require a subscription or one-time payment, the
details of which are specified at the time of enrollment in the relevant offer.
● The prices of courses and subscriptions are set in advance and displayed inclusive of
all taxes (VAT).
● Promotional offers or discount codes may be made available from time to time.
7.2 Price Revision
Babylonelearning reserves the right to change its prices (courses, subscriptions, related
services) at any time, based on business policies or regulatory developments.
Any price changes will only apply to new purchases or subscription renewals.
If the User does not accept the new prices, they may stop using paid services and close
their account without additional fees.
7.3 Payment Methods
Registration and account creation on Babylonelearning are free of charge.
Access to paid services (courses, subscriptions, certifications, or additional services)
requires prior payment of the applicable fee.
Payments may be made via bank card or secure electronic payment methods through our
authorized partner providers (e.g., EL DAHABIA Card, CIB, Stripe, PayPal, MasterCard,
Visa depending on the country), or by bank transfer when available.
Cash payments are not accepted, unless otherwise required by local regulation or expressly
agreed by Babylonelearning.
7.4 Billing and Renewal
An electronic invoice is generated and sent to the User by email within forty-eight (48)
business hours following payment validation.
● Any billing dispute must be submitted to customer service within thirty (30) days of
receiving the invoice.
● In the event of delayed or failed payment, Babylonelearning reserves the right to
suspend access to the relevant services, apply reminder fees if necessary, and/or
initiate debt recovery procedures.
Subscriptions entered into with Babylonelearning are, unless otherwise specified, for a fixed
term with tacit renewal upon expiration for an identical period.
The User may opt out of automatic renewal by disabling the corresponding option in their
personal space or by submitting a request to customer service before the renewal date.
8. Data
The data collected and processed as part of the use of the Services serve as evidence in
the event of a dispute and constitute proof of transactions and interactions between the User
and Babylonelearning.
These data are retained in compliance with applicable regulations on personal data
protection.
The User may consult their data and history (orders, subscriptions, payments, interactions)
in their secure Personal Space.
9. Obligations
9.1. Obligations of the Company
Babylonelearning undertakes to:
● Provide the platform free of charge (Web).
● Offer a clear and complete presentation page of the services, and ensure the
technical management of the User’s account.
● Provide access to the history of trainings, subscriptions, and transactions carried out.
● Implement a rating and feedback system to continuously improve service quality.
● Ensure technical assistance and customer support within a reasonable timeframe.
9.2. Obligations of the E-consumer
The User undertakes to:
● Not cancel an order, service, or booking after final validation, except in cases of force
majeure or specific conditions provided (fees may apply for late cancellations).
● Not harm the reputation, integrity, or proper functioning of Babylonelearning’s
services.
● Maintain respectful behavior towards the company, its providers, and other users.
● Fully pay the amount due for any subscribed service or subscription, according to the
agreed terms.
● Ensure the protection and security of their digital assets and personal information
(Babylonelearning declines any responsibility in case of loss of items, data, or
unsecured access).
● Comply with applicable laws and regulations.
● Keep their personal and payment information up to date.
● Use the service only for personal purposes and in accordance with the general
terms.
● Secure their access to the services by using reliable devices (antivirus, secure
systems, strong password).
10. Liability
10.1. Liability of the Company
Babylonelearning is bound by an obligation of means, not of results.
It cannot be held liable for possible malfunctions related to journeys, the quality or
availability of third-party providers, payment conditions, delays, or interruptions of services
caused by external events.
● The Company reserves the right to temporarily suspend access to the platform or
website for maintenance reasons, without incurring liability.
● It cannot be held responsible in cases of force majeure, data loss, connection issues
related to the internet service provider, or third-party content beyond its control.
10.2. Liability of the E-consumer
The User guarantees the accuracy of the information provided during registration or use of
the services.
They are solely responsible for the content they publish, share, or distribute via the
application.
They must hold the necessary rights to such content, which must be lawful, compliant with
public order, and respectful of third-party rights.
11. Special Conditions
Any confirmation of a service request or booking requires the correct entry of the starting
point, destination (or equivalent depending on the service used), as well as confirmation of
the applicable conditions.
● In case of delay, the User must notify Babylonelearning or the concerned provider.
Waiting fees may be charged if the delay exceeds a reasonable time.
● Any incident encountered must be immediately reported to the Company so that it
can intervene and, if necessary, take corrective measures.
● A provider (such as a trainer or third-party service provider) may cancel a service in
case of force majeure or impossibility of execution.
● The User may cancel a booking free of charge within the specified timeframe (for
example, less than ten seconds for certain instant services). After this period,
cancellation fees may apply.
12. Prohibited Behaviors
The User is strictly forbidden to:
● Use the platform for purposes other than those provided for in these Terms.
● Violate applicable laws and regulations.
● Engage in behavior contrary to good morals, public order, or likely to harm the safety,
comfort, or integrity of other users and providers.
● Insult, harass, intimidate, threaten, or verbally/physically assault any provider,
employee, or other user.
● Commit fraud, provide false information, or make fictitious requests.
Any serious breach of these rules may result in the immediate suspension or permanent
deletion of the User’s account, without prejudice to possible legal proceedings.
13. Sanctions
Babylonelearning reserves the right, in case of non-compliance with these Terms of
Use or inappropriate behavior, to take any measures deemed necessary, including:
● Temporarily or permanently suspending access to the platform;
● Deleting any unlawful content or content contrary to these Terms;
● Notifying the competent authorities;
● Initiating any appropriate legal action.
14. Intellectual Property
All systems, software, educational content, documents, courses, videos, texts, images,
graphics, logos, and other elements available on the platform are protected by the
intellectual property laws in force.
Any reproduction, representation, distribution, or unauthorized use, whether total or partial,
is strictly prohibited and may lead to legal proceedings.
15. Personal Data
Users’ personal data are collected and processed in accordance with the Privacy Policy
available on the platform and in compliance with applicable data protection laws.
16. Links and Third-Party Sites
The Babylonelearning platform may contain links to third-party websites or services.
Babylonelearning declines all responsibility for the content, products, services, or
transactions offered on such third-party sites, over which it has no control.
17. Duration and Unsubscription
Babylonelearning services are subscribed for an indefinite duration.
The User may request the deletion of their account at any time via their personal space or,
where applicable, by uninstalling the application.
18. Modifications
Babylonelearning may modify these Terms of Use at any time to reflect legal, technical, or
organizational developments.
If the User refuses the modifications, they must stop using the platform and request the
deletion of their account.
Continued use of the platform after the publication of modifications constitutes acceptance
of the new Terms.
19. Complaints
For any questions, requests, or complaints, the User may contact Babylonelearning using
the contact details provided in Article 2 of these Terms.
20. Applicable Law and Jurisdiction
These Terms of Use are governed by the laws applicable in the countries where
Babylonelearning operates (

United States,
Ireland,
European Union).
Any dispute will be submitted to the competent courts of the territorially concerned
jurisdiction.
21. Entry into Force
These Terms of Use come into effect upon their acceptance by the User, materialized by
clicking on the “Accept” button.
Special Conditions – Babylonelearning
➢ Types of Training (Course Types)
The platform offers several categories of training courses to meet diverse educational
needs:
● Standard courses: basic courses accessible to all users, permanently available.
● Premium courses: advanced or specialized programs accessible through paid
subscription.
● Promotional courses: temporary or limited-access sessions offered as part of
promotions or specific events.
● Restricted courses: some courses may be limited to a specific geographic area or
target audience, for contractual or legal reasons.
➢ Specialized Educational Support
In addition to online training, Babylonelearning may provide:
● Individual or group tutoring with certified instructors.
● Programs tailored to specific needs (exam preparation, targeted professional
learning).
● Inclusive sessions to address special educational needs (accessibility, inclusion,
disability).
➢ Certification and Recognition
Some courses provide a certificate of participation issued by Babylonelearning.
Other programs may grant access to an official certification recognized by partner
institutions, as specified in the course description.
Certificates are nominative and cannot be transferred to a third party.
➢ Access to Content
Courses are accessible online through the website.
Some content may be made available offline, subject to prior download in the application.
The duration of access to a course depends on the selected plan (monthly subscription,
one-time purchase, limited access).
➢ Technical Support and Assistance
Babylonelearning provides users with:
● An FAQ and a freely accessible knowledge base.
● A support service via email, chat, or phone (depending on availability in each
country).
● Priority assistance for Premium subscribers.
➢ Use of Educational Resources
All materials (videos, documents, tests) are protected by copyright.
Any unauthorized reproduction, distribution, or use is strictly prohibited.
The use of resources is strictly limited to personal and non-commercial purposes.
➢ Program Updates
Babylonelearning reserves the right to adapt or update educational content in order to
ensure its relevance and compliance with educational standards.
Users will be notified in case of the removal or replacement of a course.
